Updated SwingDx – Terms of Service (TOS)

1. Overview

SwingDx (“the Service,” “we,” “our,” or “us”) provides golf swing performance analysis using motion-capture data, biomechanical interpretation, and user-submitted personal information. By using this website, submitting intake information, completing any authorization forms, or purchasing any product, you (“you,” “the client,” or “user”) agree to these Terms of Service.

If you do not agree with these Terms, please do not use the Service.

2. Nature of the Service

SwingDx provides informational and educational biomechanical insight into golf swing patterns.
Although SwingDx collects health-related information through an intake form and personal narrative, this is used only to contextualize your swing data, not to diagnose or treat any medical condition.

SwingDx does not provide:

  • Medical evaluation

  • Medical diagnosis

  • Medical treatment

  • Rehabilitation planning

  • Physical therapy

  • Clinical decision-making

  • Establishment of a patient–provider relationship

Any comments regarding mobility, movement limitations, pain, or physical compensations are general observations, not medical advice.

3. User-Provided Information

As part of the Service, you may submit:

  • Swing videos

  • Intake forms describing your history, symptoms, injuries, or goals

  • Narrative health information

  • Authorized contacts (clinicians, coaches, trainers)

  • HIPAA-compliant authorization to share your information

You acknowledge that:

  • This information is self-reported and may influence the interpretation of your swing analysis.

  • You remain responsible for the accuracy of the information you provide.

  • Submission of health-related information does not create a medical relationship.

4. HIPAA-Compliant Authorization

If you choose to complete the optional HIPAA-compliant authorization:

  • You may designate clinicians, coaches, trainers, or performance professionals who may receive your report or related information.

  • SwingDx will only share information exactly as authorized by you.

  • SwingDx does not control, monitor, or take responsibility for how those third parties use or store your information once it is shared.

Completion of an authorization does not convert SwingDx into a medical provider.

5. Purpose of Health Narrative & Intake Data

Your health narrative and intake form are used solely to:

  • Provide interpretive context around your biomechanics

  • Tailor filming instructions

  • Improve the accuracy of pattern recognition

  • Help ensure your analysis aligns with your reported limitations or goals

This contextual information is not used for diagnosis or treatment and is not a substitute for medical evaluation.

6. Payment & Refund Policy

All purchases are final and non-refundable once intake materials or swing videos are submitted, or once any part of the analysis process begins.

7. Intellectual Property

All reports, diagrams, educational materials, and platform content are the property of SwingDx. Redistribution or commercial use is prohibited without written permission.
You may share your report with clinicians, coaches, or trainers for your personal benefit.

8. Data Storage & Security

SwingDx uses secure, industry-standard storage solutions for all user-submitted data.
While your data is handled with care, SwingDx is not a medical practice and is not required to comply with the full scope of HIPAA regulations.
However, authorizations, sharing, and storage processes are structured to follow HIPAA-aligned principles for confidentiality.

9. Limitation of Liability

To the fullest extent permitted by law, SwingDx is not liable for:

  • Injury or harm resulting from physical activity you undertake

  • Interpretation or misinterpretation of the Analysis

  • Decisions you make based on your report

  • Actions or advice from third-party coaches, clinicians, or trainers

  • Any sharing you authorize through HIPAA-style release forms

You agree to use the Service at your own risk.

10. No Guarantee of Results

SwingDx does not guarantee improvements in:

  • Golf performance

  • Physical capabilities

  • Pain levels

  • Injury outcomes

  • Athletic performance metrics

Outcomes vary by individual and depend on many factors beyond the scope of the Service.

11. Right to Refuse Service

SwingDx may decline service for incomplete or unsafe submissions, inappropriate content, or other reasons at its discretion.

12. Changes to Terms

SwingDx may update these Terms periodically. Continued use of the Service constitutes acceptance of the revised Terms.
